{"id":8825,"date":"2026-01-27T12:43:36","date_gmt":"2026-01-27T10:43:36","guid":{"rendered":"https:\/\/stichtingen.mystagingwebsite.com\/?p=8825"},"modified":"2026-01-27T12:46:07","modified_gmt":"2026-01-27T10:46:07","slug":"lettre-ouverte-au-president-de-la-commission-demande-de-revenir-sur-votre-decision-de-retirer-la-directive-relative-aux-associations-transfrontalieres-europeennes-ate","status":"publish","type":"post","link":"https:\/\/www.lesfondations.be\/fr\/open-letter-to-the-president-of-the-commission-request-to-reverse-your-decision-to-withdraw-the-directive-on-european-cross-border-associations-ecba\/","title":{"rendered":"Open letter: Request to reverse your decision to withdraw the Directive on European Cross-Border Associations (ECBA)"},"content":{"rendered":"<p>Dear President, dear Executive Vice-President,<\/p>\n<p>As representatives of the Belgian Federation of\u00a0Philanthropic\u00a0Foundations, we are writing you concerning your decision to withdraw the Directive on European Cross-Border Associations (ECBAs), which was presented by the European Commission in September 2023, approved in the first reading by the European Parliament in March 2024, and under discussion in the Council.<\/p>\n<p>The Directive would allow associations with membership and operations in different Member States to be automatically recognised throughout the Union and to operate across borders at the same conditions as national ECBAs. We underline how the Directive does not establish a new European legal form. It creates harmonisation of a national legal form with some common\u00a0 European characteristics and advantages, while most of the features will be adapted to the national laws on associations. The Directive would also recognise the core-features of the non-profit model of enterprise that provides economic services of general interest in the internal market, hence providing a level-playing field with other economic enterprises.<\/p>\n<p>As the Federation of Belgian Philanthropic Foundations, we support the Directive as it contributes to removing legal and administrative obstacles that non-profit organisations and citizens face in cooperating in cross-border regions, macro-regions or in the different EU countries and therefore enhances their ability to contribute to the general interest and the public good.
